1.Acceptance of Terms
By creating an account, accessing, or using RealSkin Lab, you agree to these Terms of Service and our Privacy Policy.
If you do not agree to these Terms, you may not create an account or use the service.
You represent that you have the legal capacity to enter into and comply with these Terms.
RealSkin Lab is operated by ECHOES OF INTRIGUE LLC, a Florida limited liability company. References in these Terms to "RealSkin Lab," "we," "us," or "our" refer to ECHOES OF INTRIGUE LLC as the company operating the RealSkin Lab platform.
2.Description of Service
RealSkin Lab provides AI-powered skin-look generation, image rendering, and related digital creative tools.
The service allows users to submit photographs, reference images, prompts, settings, and other materials to generate visual content using artificial intelligence and third-party AI models.
Renders and other generated outputs are provided for personal and commercial use, subject to these Terms and the restrictions described below.
AI-generated results may vary depending on prompts, reference materials, settings, models, generation parameters, and other factors.
3.Age and Account Eligibility
You must be at least 18 years old to create an account or use RealSkin Lab.
By creating an account or using RealSkin Lab, you represent and warrant that you are at least 18 years of age and legally capable of agreeing to these Terms.
RealSkin Lab is not intended for or directed to individuals under the age of 18. Individuals under 18 may not create an account or use the platform.
If we become aware that an account is being used by an individual under the age of 18, we may restrict, suspend, or terminate the account and take appropriate action regarding associated information in accordance with applicable law and our Privacy Policy.
4.Account Responsibility
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account.
You agree to provide accurate account information and to keep your account information reasonably current.
You may not allow another person to use your account in a manner that violates these Terms or applicable law.
If you suspect unauthorized access to or use of your account, notify us promptly at support@therealskinlab.com.
5.Acceptable Use and Prohibited Content
RealSkin Lab is intended for lawful creative, visual-content, branding, entertainment, and related digital-production purposes.
You agree not to use RealSkin Lab to create, upload, request, generate, modify, distribute, publish, transmit, or facilitate content that:
- ·Exploits, sexualizes, endangers, or depicts the sexual abuse of minors, including generated, fictional, manipulated, or synthetic representations.
- ·Creates or distributes non-consensual intimate or sexually explicit imagery of another person.
- ·Uses another person's identity, likeness, image, voice, or other identifying characteristics in a deceptive, fraudulent, defamatory, exploitative, or harmful manner, including harmful impersonation or deceptive deepfakes.
- ·Harasses, threatens, abuses, stalks, intimidates, or facilitates harm against another person.
- ·Is unlawful, defamatory, or otherwise violates applicable law.
- ·Violates or infringes another person's privacy, publicity rights, copyright, trademark, intellectual-property rights, contractual rights, or other legal rights.
- ·Promotes, facilitates, assists with, or constitutes illegal activity.
- ·Attempts to circumvent, disable, interfere with, or evade RealSkin Lab's safeguards, security measures, usage restrictions, generation limits, content controls, or other protective systems.
- ·Attempts to gain unauthorized access to RealSkin Lab, another user's account, connected systems, infrastructure, or data.
You are responsible for ensuring that your use of RealSkin Lab and any content you create, upload, distribute, publish, or otherwise use through the service complies with applicable law and these Terms.
RealSkin Lab reserves the right, where appropriate, to restrict generation capabilities, reject generation requests, remove or restrict prohibited content, suspend or terminate accounts, limit access to the service, and take other appropriate action when these rules are violated.
We may also take reasonable measures to prevent abuse, fraud, unauthorized access, circumvention of service restrictions, or misuse of the platform.
6.User-Provided and Reference Content
You may upload or submit photographs, reference images, prompts, text, instructions, and other materials to RealSkin Lab only when you have the legal right, authorization, consent, licence, or other necessary permission to use those materials.
By submitting content to RealSkin Lab, you represent and warrant that:
- ·You own the submitted content or have all rights and permissions necessary to submit and use it through RealSkin Lab;
- ·Your submission and use of the content through RealSkin Lab do not violate another person's privacy, publicity, copyright, trademark, intellectual-property, contractual, or other legal rights;
- ·Where another identifiable person appears in or is represented by submitted material, you have any authorization or permission required by applicable law for the intended use; and
- ·Your content and intended use comply with these Terms and applicable law.
You remain responsible for the photographs, reference images, prompts, and other materials you upload or submit, as well as for your use of content generated through RealSkin Lab.
RealSkin Lab does not grant you rights to third-party content, identities, likenesses, trademarks, copyrighted works, or other materials merely because the service is capable of processing or generating content relating to them.
7.Intellectual Property
You retain ownership of images, photographs, reference materials, prompts, and other content that you own and upload to RealSkin Lab.
You grant RealSkin Lab a limited licence to host, process, reproduce, transmit, and otherwise use submitted materials only as reasonably necessary to operate and provide the service, including generating requested outputs and maintaining service functionality, subject to our Privacy Policy.
Nothing in these Terms transfers ownership of your original uploaded content to RealSkin Lab.
Generated outputs are licensed to you for personal and commercial use, subject to applicable law, third-party rights, these Terms, and any restrictions that may apply to third-party services or models used in providing the service.
You may not access, copy, extract, reproduce, sublicense, distribute, reverse engineer, or otherwise attempt to obtain underlying model weights, proprietary systems, source code, or other protected technology used to operate RealSkin Lab except where such restriction is prohibited by applicable law.
You are responsible for determining whether your intended use of generated content requires additional permissions, licences, releases, or consents from third parties.
8.Billing, Credits, Cancellations, and Refunds
Subscription fees are billed in advance according to the plan and billing cycle selected at the time of purchase.
If you cancel a subscription, the subscription will not renew after the end of the current paid billing period, and you may continue to access applicable subscription benefits until that period ends unless otherwise stated.
Credits, render packs, pay-as-you-go purchases, refunds, billing errors, technical failures, and other payment-related matters are subject to our separate Refund Policy.
Credits that have already been consumed are generally non-refundable except where required by applicable law or expressly provided under our Refund Policy.
We reserve the right to change pricing, subscription plans, credit requirements, included features, or other commercial terms. Where a pricing change affects an existing subscription, we will provide at least 30 days' notice where reasonably practicable or as otherwise required by applicable law.
Payment processing may be provided by third-party payment providers. Your use of those payment services may also be subject to the applicable provider's terms and policies.
9.Referral Programme
RealSkin Lab may offer a Refer & Earn programme or other referral programme from time to time.
Commission or referral earnings may be paid through a designated payment provider after any applicable minimum payout threshold and programme requirements have been satisfied.
Eligibility, commission amounts, thresholds, qualifying transactions, payout schedules, and other referral terms may be subject to additional programme rules made available through the service.
RealSkin Lab may modify, suspend, or discontinue the referral programme at any time with reasonable notice where appropriate.
Fraudulent, abusive, manipulated, self-referral, or otherwise improper referral activity may result in the cancellation of commissions, suspension from the referral programme, or other appropriate account action.
10.Disclaimer of Warranties
RealSkin Lab and the service are provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by applicable law.
We do not warrant that:
- ·Generated results will meet your expectations or achieve any particular creative or commercial outcome;
- ·Generated content will be completely accurate, unique, error-free, or suitable for a particular purpose;
- ·The service will always be uninterrupted, secure, available, or free from errors;
- ·Every generation request will successfully complete; or
- ·AI-generated outputs will be free from similarities to third-party content.
AI-generated content is probabilistic and may produce unexpected, inaccurate, incomplete, or undesirable results.
You are responsible for reviewing generated content before publishing, distributing, selling, relying upon, or otherwise using it.
To the extent permitted by law, RealSkin Lab disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and satisfactory quality.
11.Limitation of Liability
To the maximum extent permitted by applicable law, RealSkin Lab and its owners, officers, employees, contractors, affiliates, and service providers shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to your access to or use of the service.
This includes, where permitted by law, loss of profits, revenue, business opportunities, data, goodwill, reputation, or other intangible losses arising from:
- ·Your use of or inability to use RealSkin Lab;
- ·Generated content or generation results;
- ·Unauthorized access to your account;
- ·Service interruptions, technical failures, or loss of data;
- ·Your reliance on generated content; or
- ·Conduct or content of another user or third party.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
12.Suspension and Termination
RealSkin Lab may restrict, suspend, or terminate access to some or all of the service if we reasonably believe that:
- ·You have violated these Terms;
- ·Your account is being used for prohibited or unlawful activity;
- ·You have attempted to circumvent security, safeguards, usage restrictions, payment requirements, or content controls;
- ·Your use creates a security, legal, regulatory, fraud, abuse, or operational risk; or
- ·Suspension or termination is otherwise reasonably necessary to protect RealSkin Lab, its users, third parties, or the integrity of the service.
Where appropriate and legally permitted, we may provide notice of an account restriction or termination.
Termination does not eliminate obligations or liabilities that arose before termination.
13.Governing Law and Disputes
These Terms and any dispute arising out of or relating to these Terms or the use of RealSkin Lab will be governed by the laws of the State of Florida, without regard to its conflict-of-law principles.
Any dispute arising from or relating to these Terms or the service shall be resolved through binding arbitration unless applicable law requires otherwise or prevents the applicable dispute from being resolved through arbitration.
Nothing in this section limits any rights or remedies that cannot legally be waived under applicable consumer-protection or other mandatory laws.
14.Changes to These Terms
We may update these Terms from time to time to reflect changes to the service, legal or regulatory requirements, business practices, security considerations, or other operational needs.
If we make material changes, we will provide notice by email, in-app notification, website notice, or another reasonable method at least 14 days before the changes take effect, unless a shorter period is required for legal, security, fraud-prevention, or other urgent reasons.
The updated Terms will state the date on which they were last revised.
Your continued use of RealSkin Lab after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
