These Referral Program Terms ("Referral Terms") govern participation in the RealSkin Lab referral program ("Referral Program").
RealSkin Lab is operated by ECHOES OF INTRIGUE LLC, a Florida limited liability company. References in these Referral Terms to "RealSkin Lab," "we," "us," or "our" refer to ECHOES OF INTRIGUE LLC.
By participating in the Referral Program, generating or sharing a RealSkin Lab referral link, or earning referral commissions, you agree to these Referral Terms as well as the RealSkin Lab Terms of Service and other applicable policies.
1.Referral Program Overview
The Referral Program allows eligible participants to earn recurring commissions when qualifying customers are referred to RealSkin Lab through the participant’s unique referral link and those customers make qualifying subscription payments.
The program currently uses a two-tier referral structure:
Tier 1 — Direct Referrals
Participants may earn a 20% recurring commission on qualifying subscription payments made by customers who are directly referred through the participant’s unique referral link.
Tier 2 — Indirect Referrals
Participants may earn a 5% recurring commission on qualifying subscription payments made by customers referred by the participant’s Tier 1 referrals.
Tier 2 commissions apply only where the applicable referral relationship is properly recorded and attributed through the RealSkin Lab referral tracking system.
Commissions are calculated on the amount received after excluding the payment processor’s fee.
Participants are solely responsible for any taxes owed on commissions earned through the Referral Program, subject to applicable law. RealSkin Lab does not withhold taxes from commission payments except where required by applicable law.
Where required by applicable law, participants may be asked to provide tax identification information (such as a completed Form W-9 or equivalent for U.S. participants, or an appropriate foreign-status form such as Form W-8BEN or W-8BEN-E or equivalent for participants outside the United States) before receiving a payout. RealSkin Lab does not provide tax, legal, or accounting advice; participants should consult their own tax advisor regarding their individual obligations.
The Referral Program is open to participants located outside the United States. International participation, referral tracking, and commission accumulation are not placed on hold on a country-wide basis. If a specific participant has not completed tax documentation required for their circumstances, only that participant’s payout is held until it is complete — their accrued balance is not forfeited and continues to accumulate.
2.Qualifying Subscription Payments
Referral commissions apply only to successfully paid, qualifying subscription payments that are properly attributed through the RealSkin Lab referral system.
A commission is not earned merely because a person:
- ·Clicks a referral link;
- ·Creates an account;
- ·Begins a checkout process;
- ·Starts a free account or free experience; or
- ·Attempts a payment that is not successfully completed.
A qualifying commission requires a successfully completed subscription payment that otherwise satisfies these Referral Terms.
3.Recurring Commissions
Eligible Tier 1 and Tier 2 commissions are recurring.
Recurring commissions may continue while the applicable referred subscription remains active and successfully paid, subject to these Referral Terms.
If a qualifying referred customer cancels their subscription, future subscription periods that are not successfully paid will not generate additional recurring commissions.
Cancellation does not create a commission for any future unpaid subscription period.
If a qualifying referred customer’s subscription later becomes active again, recurring commissions resume automatically on subsequent qualifying payments, without requiring the referral relationship to be re-established.
Recurring commissions are calculated based on the actual amount of each qualifying payment, such that a referred customer’s plan upgrade or downgrade is automatically reflected in future commission amounts.
RealSkin Lab may withhold, reduce, or terminate future recurring commissions for a participant whose account is disabled, suspended, or removed from the Referral Program under these Referral Terms.
4.Refunds, Reversals, Disputes, and Chargebacks
Payments that are:
- ·Refunded;
- ·Reversed;
- ·Disputed;
- ·Charged back; or
- ·Otherwise not successfully retained as a qualifying payment
do not qualify for referral commission.
If a commission has already been credited in connection with a payment that is later refunded, reversed, disputed, charged back, or otherwise determined not to qualify, RealSkin Lab may reverse, deduct, cancel, or adjust the corresponding commission.
Chargebacks and disputes are reviewed by RealSkin Lab on a case-by-case basis. A participant who believes a commission was adjusted in error, or who wishes to report suspected fraud or a chargeback-related concern, may contact RealSkin Lab at support@therealskinlab.com.
5.Referral Attribution
To qualify for commission, a referral must be properly attributed through the RealSkin Lab referral tracking system.
Participants are responsible for using their assigned referral link when promoting RealSkin Lab.
Referral commissions cannot be guaranteed where a referral cannot be properly identified or attributed through the RealSkin Lab referral tracking system.
The referral relationship recorded by the RealSkin Lab system will be used to determine whether an eligible referral qualifies as Tier 1 or Tier 2, subject to review for fraud, abuse, errors, or other violations of these Referral Terms.
Where a prospective customer uses more than one referral link before creating an account, attribution is based on the most recently used referral link at the time the account is created.
Referral attribution is not guaranteed for any fixed period of time and does not persist beyond the browser session in which the referral link was used. If an account is created in a new browser session without using a referral link, no referral is attributed.
6.Self-Referrals
Self-referrals are not permitted.
Participants may not use their own referral link to create another account, subscription, identity, or other arrangement for the purpose of generating referral commissions for themselves.
Participants may also not attempt to indirectly accomplish a self-referral through duplicate accounts, alternate identities, controlled accounts, or similar arrangements.
Commissions associated with prohibited self-referrals may be withheld, cancelled, or reversed.
7.Fraud and Abuse
Participants may not engage in fraudulent, misleading, abusive, manipulative, or artificial referral activity.
Prohibited activity includes, but is not limited to:
- ·Creating or using fake accounts;
- ·Duplicate-account abuse;
- ·Manipulating referral tracking;
- ·Artificially generating clicks, registrations, subscriptions, or payments;
- ·Misrepresenting the identity or source of a referral;
- ·Attempting to circumvent referral-program controls;
- ·Coordinating transactions primarily for the purpose of improperly generating commissions;
- ·Using deceptive or misleading promotional practices; or
- ·Otherwise attempting to improperly obtain referral commissions.
RealSkin Lab may review referral activity where fraud, abuse, manipulation, or unusual activity is suspected.
8.Accurate Promotion
Participants are responsible for promoting RealSkin Lab accurately.
Participants must not make false, misleading, unauthorized, or unsubstantiated claims regarding RealSkin Lab, including claims about:
- ·Pricing;
- ·Subscription plans;
- ·Features;
- ·AI capabilities;
- ·Render quality;
- ·Offers or promotions;
- ·Referral earnings;
- ·Discounts;
- ·Availability; or
- ·Any other aspect of the RealSkin Lab platform or service.
Participants may not represent themselves as employees, agents, legal representatives, or authorized spokespersons of RealSkin Lab unless expressly authorized to do so.
9.Program Enforcement
RealSkin Lab may suspend, restrict, or remove a participant from the Referral Program if we reasonably determine that the participant has engaged in fraud, abuse, manipulation, prohibited self-referrals, misleading promotion, violation of these Referral Terms, or other improper conduct.
Where appropriate, RealSkin Lab may also:
- ·Withhold commissions associated with suspected or confirmed violations;
- ·Reverse previously credited commissions;
- ·Remove invalid or improperly attributed referrals;
- ·Restrict access to referral-program features; or
- ·Take other reasonable action necessary to protect the integrity of the Referral Program.
These actions may apply to commissions associated with fraudulent, abusive, manipulated, refunded, disputed, reversed, charged-back, or otherwise non-qualifying transactions.
10.Program Administration
Certain operational aspects of the Referral Program may depend on the referral, subscription, and payment systems used by RealSkin Lab.
Eligible commission payouts require a minimum cleared balance of $20, and are processed automatically once per month, on the 1st. There is no on-demand or pay-on-request option.
A commission must clear a 7-day holding period, measured from the date it was earned, before it counts toward a monthly payout. This protects against paying out commission tied to a transaction that is later refunded, reversed, disputed, or charged back.
The monthly cutoff for each payout is the 1st of the month: any commission that has both reached the end of its 7-day holding period and is not tied to a refunded, reversed, disputed, fraudulent, or charged-back transaction by that date is included in that month’s payout.
If a participant’s cleared balance is below $20 as of the monthly cutoff, no payout is made that month. The balance is not forfeited and carries forward to future periods until it reaches $20 or is otherwise adjusted under these Referral Terms.
Alternatively, a participant may redeem an accrued balance of at least $0.50 as a discount toward a RealSkin Lab subscription purchase at any time, even before it has cleared the holding period or reached the $20 payout threshold.
Commission tied to a transaction that is refunded, reversed, disputed, found fraudulent, or charged back does not become payable, and may be reversed from a participant’s balance even after it was believed to be cleared.
If a payout attempt fails, RealSkin Lab may retry the transfer, consistent with the capabilities of its payment processor.
Operational details beyond what is stated above, where applicable, will be governed by the actual Referral Program configuration and any additional information made available by RealSkin Lab.
11.Changes to the Referral Program
RealSkin Lab may modify, suspend, or discontinue the Referral Program or update these Referral Terms where reasonably necessary for operational, technical, fraud-prevention, legal, commercial, or other legitimate business reasons.
Where appropriate, updated Referral Terms will be published on the RealSkin Lab website with an updated revision date.
Changes will not cause transactions that did not otherwise qualify under the applicable Referral Terms to become qualifying transactions.
12.Relationship to the RealSkin Lab Terms of Service
Participation in the Referral Program is also subject to the RealSkin Lab Terms of Service and other applicable policies.
If these Referral Terms address a matter specifically relating to referral commissions or participation in the Referral Program, these Referral Terms apply to that referral-program matter.
Nothing in these Referral Terms creates an employment, agency, partnership, joint venture, franchise, or similar relationship between a participant and RealSkin Lab.
